Great Lakes Challenge

AMATEUR ATHLETIC WAIVER AND RELEASE OF LIABILITY
- READ BEFORE SIGNING -

In consideration of being allowed to participate in the Great Lakes Challenge August 21, 2022 hosted by CROSSFIT FBO /212 DEGREES OF FITNESS’s LLC, ("FBO") the undersigned acknowledges and agrees that:

Assumption of Risk: I acknowledge that this athletic event is an extreme test of a person’s physical and mental limits. The risk of injury from the activities involved in this event is significant and includes the potential for severe injury, disability, permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, such risk does exist. By signing this Waiver and Release I acknowledge that I am aware of such risks and I accept and assume all such risks, both known and unknown, whether arising from my negligence or the negligence of FBO their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), or others, and assume full responsibility for my participation; and,

I hereby acknowledge that I have no known physical impairments, injury or illness that will endanger me or others.

Release: I, on behalf of my successors, assigns, heirs, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS FBO and the Releasees, WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, PARALYSIS or DEATH, or loss or damage to person or property, whether arising from my negligence or the negligence of FBO, the Releases or others, to the fullest extent permitted by law.

Indemnification: I have read and fully understand this WAIVER AND RELEASE and accept the inherent risk to me by participating in this event hosted by FBO and I do hereby indemnify FBO, and all Releases against any liability due to injury, including but not limited permanent disability, paralysis, or death or financial loss suffered by me or that I may have intentionally or unintentionally caused to any other person on the premises during this event, and for any damage to any property that may result from any negligence, act or omission while participating this event hosted by FBO whether at their primary location or any other place that is being used by FBO for their sanctioned event.

Limitation of Liability: In no event will FBO or the Releasees be liable to me for any consequential, indirect, special, incidental or punitive damages, regardless of the form of action, whether in an agreement, tort, or otherwise, even if advised of the possibility of such damages and even if the damages were foreseeable.

I willingly agree to comply with the stated and customary terms and conditions for participation. If I observe any unusual or significant hazard or risk during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and, I have read and understand the forgoing Waiver and Release. I understand that I am waiving certain legal rights by signing Electronically this Waiver and Release.

Inclement Weather:  The Great Lake Challenge is being held out of doors, and therefore the possibility of inclement weather exists. This event will not be cancelled or postponed due to inclement weather or cold temperatures although all measures will be taken to ensure the safety of all participants and judges. In the event of lightening or dangerous conditions events may be modified, cancelled or postponed at the sole discretion of FBO.

NO REFUNDS DUE TO WEATHER: FBO will not issue refunds for entry fees resulting from cancellation due to weather conditions.

FOR PARTICIPANTS OF MINORITY AGE
(UNDER AGE 18 AT THE TIME OF REGISTRATION)

This is to certify that I, as parent/guardian with legal responsibility for this minor participant, do consent and agree to his/her release as provided above of all the Releasees, and for myself, my successors, assigns, heirs and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child's involvement or participation in these programs as provided above, whether such injury is due to the negligence of the minor child or FBO, the Releasees or others, to the fullest extent permitted by law.
